The Pennsylvania Courts just ruled that an employee that had been employed as a sales person for ten years and that had signed an agreement restricting his right to compete with the employer on his own or by working for a competitor was not enforceable where the employer fired the employee/sales-person. On the other hand, provisions regarding non-disclosure that are properly drafted are enforceable which can effectively prevent your employee/sales-person from offering a competitive advantage when he/she no longer works for you.
